Section 35
Rights of the Fund
: (1) After the payment of the claim of the secured depositor in accordance with the provisions of this Act, the Fund shall have the right of appropriation to the extent of the payment made by the Fund.
(2) In financial liquidation or liquidation process, the claim of the fund shall be recognized and prioritized as a safe deposit in accordance with the prevailing law.
(3) The right of transfer of the fund under sub-section (1) shall not affect the right of the depositor to seek remedy in accordance with the prevailing law in the event that the deposit amount is more than the amount paid by the fund to the protected member institution.
